Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 18.10.2021 in connection with Joda P.S. Case No.169 of 2021 corresponding to G.R. Case No.588 of 2021 pending in the Court of learned J.M.F.C., Barbil for the alleged commission of offence under Sections 147/148/341/294/332/323/324/325/186/307/395/427/149/120-B/ 302 of IPC read with Section 7 of Crl. Law Amendment Act and Section 150/151/152 of Railway Act and Section 3 of PDPP Act 4.

The prosecution allegation is that the petitioner led a mob of 100 persons that ransacked the Railway Police Station at Joda and assaulted several police personnel causing grievous injuries. It is submitted that save and except the bald allegation that the petitioner instigated others to commit such act, there is no direct allegation against her of either taking part in the ransacking of the Police Station or of assaulting any staff, 5.

Having regard to the submission as above, the materials on record, the period of detention and the fact that charge sheet has

already been submitted, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that she shall personally appear before the Court in seisin over the matter on each date of posting of the case and in case of even a single default necessary orders shall be passed to take her to custody again. Further she shall appear before the IIC of Joda Police Station on every Monday at 10 a.m. for a period of six months and such fact shall be certified by the IIC to the concerned Court once in every month.

BLAPL is accordingly disposed of.
