CORAM:

MR. JUSTICE R.K. PATTANAIK

ORDER

06.09.2024 I.A. No.2288 of 2024 Order No.

02. 1.

Heard learned counsel for the petitioners.

2.

Instant petition is filed by the petitioners seeking extension of time to surrender before the learned Court below. 3.

This Court by order dated 22nd December, 2022 in CRLMC No.3870 of 2022 had directed the petitioner to surrender before the Court of learned Nayadhikari, Gram Nyayalaya, Ghasipura within a stipulated period, which learned counsel appearing for them submits that it could not be complied with, hence, the extension is sought for on the ground stated. 4.

Though there has been inordinate delay as the Court's order is of the year 2022, considering the reason assigned, the petitioners since requested for extension of time to surrender, the same should be allowed in the interest of justice. 5.

Hence, it is ordered.

6.

In the result, the I.A. stands disposed of with a direction to the petitioners to surrender before the Court of learned Nayadhikari, Gram Nyayalaya, Ghasipura on or before 20th September, 2024 in connection with GR(GN) Case No.460 of 2020 arising out of Ramachandrapur P.S. Case No.222 of 2020 and till such time, the execution of NBWA against them shall not be executed.

7.

Rest of the order remains unaltered.

8.

Urgent certified copy of this order be issued as per rules. (R.K. Pattanaik) Judge Balaram Signed by: BALARAM BEHERA Designation: Personal Assistant Reason: Authentication Location: HIGH COURT OF ORISSA, CUTTACK Date: 11-Sep-2024 11:16:29
