This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner.

This is an application under Section 439 of the Code of Criminal Procedure filed by the Petitioner for bail in connection with Berhampur Sadar P.S.Case No.273 of 2021, corresponding to G.R.Case No.146 of 2021, pending in the Court of the learned Additional Sessions Judge-cum-Special Court under POCSO Act, Berhampur for alleged commission of offence under Sections 506, 450, 376(1) of the Indian Penal Code read with Section 4/12 of the POCSO Act.

Learned counsel for the Petitioner does not want to press this bail application and wants to withdraw the same at this juncture and prays that the trial court be directed to expedite the trial and the same be concluded within a stipulated period of time. 5.

Considering the aforesaid submissions, while disposing of the bail application of the Petitioner as withdrawn, this Court directs the

// 2 // trial court to expedite trial and conclude the same within a period of three months. In the event trial is not concluded within the aforesaid period, it is open for the Petitioner to move an application for bail and in the event such a bail application is filed the same shall be considered without being influenced by any other factor. 6.

Issue urgent certified copy of this order as per Rules. RKS ( A.K. Mohapatra ) Judge
