Heard Mr. B.P. Pradhan, learned counsel for the petitioners and Mr. R.C. Mohanty, learned counsel for opposite parties nos. 2 to 4.

The petitioners have filed this writ petition seeking direction to the opposite parties to take a decision on the application filed by them for issuance of revalidated Essential Certificate (NOC) pursuant to the notice dated 27.11.2019 issued by the DMET, Odisha. 4.

Mr. Pradhan, learned counsel for the petitioners contended that the petitioners had made an application for grant of NOC for establishment of GNM Training College, which was granted vide Annexure-2. After obtaining NOC from the State Government, the petitioners approached the Indian Nursing Council for issuance of approval. Since there was delay in obtaining approval, the petitioners approached the State authorities in the year 2009 for revalidation of the NOC. Accordingly, inspection was conducted vide Annexure-3.

But thereafter notice was issued by the DMET to submit fresh application along with requisite fees. Pursuant thereof the petitioners submitted an application, along with requisites fees, on 09.02.2021. But till date no decision has been taken by the authority. 5.

In view of the above, this Court disposes of the writ petition directing opposite party no.3 to conduct inspection and take a decision on the application filed by petitioners for issuance of revalidated NOC, as expeditiously as possible, preferably within a period of three months from the date of communication of the certified copy of this order.
