This matter is taken up through hybrid mode.

The petitioner has filed this writ petition seeking direction to the opposite parties to extend the benefit of compassionate allowance as provided under Rule-46 of the OCS (Pension) Rule, 1992 in terms of the letter issued on 29.07.2021 under Annexure-6 forthwith.

In course of hearing, learned counsel for the petitioner states that the case of the petitioner has already been recommended by opposite party no.2 with regard to sanction of compassionate allowance vide Annexure-6 dated 29.07.2021 to the opposite party no.4 and, therefore, direction may be given to disburse the same within a stipulated time, to which learned State Counsel has raised no objection. 4.
As agreed by learned counsel for the parties, this Court disposes of the writ petition directing opposite party
no.4 to take a decision on the recommendation made by the opposite party no.2 under Annexure-6 for disbursement of compassionate allowance to the petitioner which has been sanctioned and pass appropriate order in accordance with law, as expeditiously as possible, preferably within a period of three months from the date of receipt of certified copy of this order.
Issue urgent certified copy as per rules.
