This matter is taken up through hybrid mode.

The Petitioner in this writ petition seeks to assail the order dated 5th September, 2021 (Annexure-3) passed by the Tahasildar, Berhampur in Mutation Case No.3155 of 2021.

In course of hearing, Mr. Das, learned counsel for the Petitioner submits that interest of justice will be best served, if the Petitioner files an appeal against the order impugned herein under Rule 42 of the Orissa Survey & Settlement Rules, 1962. He, therefore, prays for withdrawal of the writ petition.

Considering such submission, this writ petition is disposed of as withdrawn.

It is made clear that in the event the Petitioner files an appeal within a period of two weeks hence along with petition for condonation of delay in filing the appeal, the appellate authority may take a liberal view in entertaining the petition for condonation of delay taking into consideration the pendency of the writ petition before this Court since 13th December, 2021 along with other grounds.

Urgent certified copy of this order be granted on proper application.
