This matter is taken up through Hybrid Mode.

Heard Mr. S.Mishnra, learned counsel for the petitioner and Ms. S.Mishra, learned Additional Standing Counsel for the State.

Taking note of submission of the learned counsel for the petitioner, i.e., prayer for release of the vehicle under Section 457 Cr.P.C. by virtue of his application CRLMC No.1 of 2021arising out of C.T. Case No. 26 of 2018 is not being considered since 12.2.2021 because of the absence of the Presiding Officer (Additional District Judge, Phulbani).

Taking into account such submission, this Court directs the learned Sessions Judge, Phulbani to consider the application of the Petitioner for release of the vehicle (CRLMC No.1 of 2021)

within a period of two weeks from the date of receipt of a certified copy of this order.

The Registry is requested to communicate this order to the learned Sessions Judger, Phulbani.

6.

With the aforesaid observation the CRLMC is disposed of.
