Heard Mr. D. Mishra, learned counsel appearing for the petitioner and Mr. S. Rath, learned Additional Standing Counsel appearing for the State-opposite parties.

Pursuant to tender call notice issued vide Tender Reference No. PS Gudvella/HST/2022-23/02 for "supply of Duel Desk Bench" for phase-III HST of Gudvella block, the petitioner along with other 13 bidders participated and out of them, the petitioner and one Shiv Shankar Industries, Sambalpur qualified. But subsequently, it was found that Shiv Shankar Industries, Sambalpur had not submitted both CR sheet i.e. front Modesty panels and bottom shelf, therefore, its bid was rejected by the tender committee. Therefore, the petitioner remains single bidder pursuant to Annexure-3 dated 02.12.2022.

In the above view of the matter, this Court does not find any illegality or irregularity in passing the impugned order dated 02.12.2022 under Annexure-3 in cancelling the bid of the

petitioner.

Accordingly, the writ petition merits no consideration and the same is dismissed.
