Heard learned counsel for the parties.

The petitioner has filed this writ petition seeking direction to the opposite parties to sanction, grant and release pay scale of Rs.9300-34800/- + G.P. of Rs.4200/- as due and admissible and also release the arrear salary as well as subsequent consequential service and financial benefits accordingly. 4.

In course of hearing, learned counsel for the petitioner states that highlighting the grievances, the petitioner has made representation to the opposite party no.2 vide Annexure-6 and the same may be directed to be disposed of within a stipulated time taking into consideration the ratio decided in the case of Harish Chandra Patra v. State of Orissa (W.P.(C) No. 5566 of 2007 disposed of on 03.07.2008) and Bhupati Bhushan Sahoo v. State of Orissa (W.P.(C) No. 15515 of 2007 disposed of on 03.07.2008), to which learned Standing Counsel for School & Mass Education Department has raised no objection. 5.

As agreed to by learned counsel for the parties, however, without expressing any opinion on the merits of the case, this writ petition stands disposed of directing the opposite party no.2 to consider the representation filed by the petitioner vide Annexure-6, taking into consideration the ratio decided in Harish Chandra Patra and Bhupati Bhushan Sahoo (supra) and pass appropriate order in accordance with law within a period of three months from the date of production of certified copy of this order.

Issue urgent certified copy as per rules.
