1. This matter is taken up through hybrid arrangement.

2. Heard learned counsel for the petitioner and learned counsel for the State.

3.This is an application filed by the petitioner to restore W.P.(C) No.4248 of 2015 to file which was dismissed for non-prosecution on 02.08.2022.

4. Learned counsel for the petitioner submits that the case was listed for hearing on 02.08.2022 but to bad luck of the petitioner, when the case was taken up for hearing through virtual mode, due to internet failure, neither the petitioner nor engaged advocate could appear for hearing of the case, resultantly, the case was dismissed for default on the said

// 2 // day. In that view of the matter, this CMAPL is allowed. WPC(OAC) No.4248 of 2015 is restored to file.

5. The CMAPL is accordingly disposed of.
