1.
This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).
2.
None appears for the petitioner at the time of call. 3.
It appears that the petitioner was on interim bail and his interim bail was extended for two weeks by an order passed on 08.07.2022 by this Court and, therefore, in all probability the petitioner was supposed to surrender in the Court seisin of the case on or before 22nd July, 2022 but till date no surrender certificate has been filed in this case. On 29.09.2022, learned counsel for the petitioner had undertaken to file surrender certificate of the petitioner in the meantime and therefore, the matter was listed on 11.10.2022, but on that day time was taken on behalf of the petitioner to furnish surrender certificate and accordingly, the petitioner was directed to produce the surrender certificate by today itself but no surrender certificate has been filed till today.
// 2 // 4.
In view of such development, the present BLAPL is dismissed for non-prosecution and the learned Court in seisin of the case is requested to proceed against the petitioner and surety in accordance with law.
