The Petitioner by filing this Application has sought for cancellation of bail granted to the Opposite Party No.2 by order dated 28.07.2020 passed by this Court in BLAPL No.4409 of 2020 in connection with G.R. Case No.857 of 2020 arising out of Berhampur Town P.S. Case No.97 of 2020 on the file of learned S.D.J.M., Berhampur running for commission of offence under Section 493/376/294/427 of the IPC.

Learned Counsel for the Petitioner files a copy of the letter received by the Petitioner from PIO-cum-IIC, Badabazar P.S. in Court today, which is taken on record.

Learned Counsel for the Opposite Party No.2 files an affidavit of Opposite Party No.2 along with the documents annexed thereto in Court today, which are taken on record. 4.

Heard learned Counsel for the Petitioner and learned Counsel for the State (Opposite Party No.1) as well as learned Counsel for the Opposite Party No.2.

Considering the submissions and on going through the averments taken in the Application as well as the subsequent affidavits, as also the documents filed by the parties, this Court is of the considered view that no case is made out for cancellation of the bail granted to the Petitioner is enjoying the liberty for about two years and three months by now.

The CRLMA is accordingly disposed of.

Issue urgent certified copy as per rules.
