This matter is taken up through Hybrid mode.

This petition has been filed by the petitioners for transfer of C.P. No.114 of 2020 instituted at the instance of the opposite party no.2-husband from the file of the learned Judge, Family Court, Kendrapara to the court of the learned Judge, Family Court, Cuttack on the ground of threat to their lives as well as for their inconvenience.

Heard the learned counsel for the petitioners and the learned counsel for the opposite party no.2.

This Court is not convinced of the ground on which the transfer is sought for, as no material is produced to substantiate the same. The distance between the places is also not far.

Considering the facts and submissions made, this Court is not inclined to entertain the prayer on the aforesaid ground. 6.

However, liberty is given to the petitioner no.1 to approach the Superintendent of Police concerned, if she apprehends any danger to her life and limb on her appearance before the Court from the side of her husband, well ahead of the date of her appearance with a copy of this order to render her necessary protection on the date of her appearance to enable the S.P. concerned to assess the threat perception on her and give necessary protection, if required. Further, if any travel expenses claimed by the petitioner no.1-wife, the Court shall pass necessary order on the same and in that event, the opposite party no.2-husband shall deposit the same in the Court concerned which shall be handed over to the petitioner no.1wife. 7.

With the aforesaid order, the TRP(C) stands disposed of. Interim order dated 22.03.2022 passed by this Court stands vacated.
