This matter is taken up through hybrid mode.

The Petitioner in this CMP seeks for a direction for early disposal of T.A. No.6 of 2022 stated to be pending before learned 2nd Additional District Judge, Cuttack. 3.

On perusal of the order under Annexure-1, it appears that the appeal has already been dismissed for non-prosecution on 13th July, 2016. Hence, the prayer made in the CMP cannot be granted.

Mr. Mohapatra, learned counsel for the Petitioner submits that after dismissal of the appeal, an application in CMA No.122 of 2016 has been filed by the Opposite Parties for restoration of the appeal, which is pending for consideration. 5.

In view of the above, the CMP is disposed of with an observation that it is open to the Petitioner to approach the learned Appellate Court for early disposal of the aforesaid CMA, if the same is still pending.

Urgent certified copy of this order be granted on proper application.
