Heard learned counsel for the petitioners and learned counsel for the State.
This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioners in connection with I.C.C. Case No.175 of 2015 pending in the court of learned J.M.F.C., Nimapara for alleged
// 2 // commission of offences under sections 341/294/326/ 506/34 of the Indian Penal Code.
Since it is a complaint case and summons have been issued to the petitioners and there is no apprehension of arrest, I am not inclined to release the petitioners on anticipatory bail.
However, in case the petitioners appear in the learned Court below and move for bail, the same shall be disposed of expeditiously in accordance with law and if any co-accused has been released on bail in the meantime, the claim of parity shall be taken into account.
The ABLAPL stands disposed of.
