Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 18.07.2021 in connection with Jeypore P.S. Case No.136 of 2021 corresponding to T.R. Case No.58 of 2021 pending in the Court of Sessions Judge-cum-Special Judge, Koraput at Jeypore for the alleged commission of offence under Sections 20(b)(ii)(C)/29 of NDPS Act.

It is alleged that the petitioner and another person were transporting contraband ganja, weighing 102 Kg in a Car when they were apprehended by police. The co-accused, namely, Aswini Naik @ Aswini Kumar Nayak @ Nasir was granted bail as per order passed by this Court in BLAPL No. 7914 of 2021. The petitioner stands exactly on the same footing as the co-accused. 5.
Having regard to the above fact, as also the period of detention of the petitioner in custody without commencement of trial, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of
posting of the case without fail.

BLAPL is accordingly disposed of.
