Learned counsel for the petitioners submitted that petitioner no.1 is known as Sanat Kumar Rout @ Sanat, but inadvertently, in the cause title it has been mentioned as 'Sarat Kumar Rout @ Sarat Rout'.
The name of petitioner no.1 be read as 'Sanat Kumar Rout @ Sanat Rout'.
Heard learned counsel for the petitioners and learned counsel for the State.
This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioners in connection with Ranpur P.S. Case No.249 of 2021 corresponding to G.R. Case No.382 of 2021 pending before the learned J.M.F.C., Ranpur for commission of alleged offences under sections 147, 148, 323, 307, 452, 324, 294, 354-B, 427, 379, 506, 149 of the Indian Penal Code. Perused the F.I.R. annexed to the anticipatory bail application.
Learned counsel for the State has produced the instruction received from the Inspector in-charge of Ranpur police station from which it indicates that the injuries sustained by the injured Biranchi Parida and Subodh Khuntia were found to be simple in nature and the injury reports of the other injured persons are yet to be obtained. Further, it is stated that the injured persons are present in their respective houses and their health condition is good.
Learned counsel for the informant opposed the prayer for anticipatory bail of petitioner nos.16 and 17. Considering the submissions made by the learned counsel for the respective parties, since specific overt-act is alleged against petitioners no. 16 Rakesh Samantaray @ Rakesh Chandra Samantaray and petitioner no.17 Rajesh
// 3 // Samantaray @ Rajesh Chandra Samantaray, while not inclining to grant anticipatory bail to them, it is observed that in the event they surrender in the learned Court below and move for bail, the learned Courts below shall dispose of the same in accordance with law expeditiously. The case records shall be made available to the Courts concerned for disposal of the bail application.
So far as petitioner nos. 1 to 15 are concerned, in view of the nature of accusation against them, I am inclined to release petitioners nos. 1 to 15 on anticipatory bail and accordingly, this Court directs that in the event of arrest of the petitioners nos. 1 to 15 in connection with the aforesaid case, they shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) each with two sureties each for the like amount to the satisfaction of the arresting officer with further conditions that they shall make themselves available for interrogation by the I.O. as and when required and they shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing any facts to the Courts or to the Investigating Officer.
Violation of any of the above conditions shall entail cancellation of bail.
The ABLAPL is accordingly disposed of.
