The petitioner has filed this writ petition seeking direction to the opposite parties to give appointment to him in any suitable post under rehabilitation assistance scheme, 1990 or OSC (RA) Amended Rules, 2016 as per Annexure-5. 3.

In course of hearing, learned counsel for the petitioner states that the case of the petitioner has already been recommended by the opposite party no.2 to the opposite party no.3 for grant of compassionate appointment under rehabilitation assistance scheme vide Annexures-5 dated 07.01.2021 and, therefore, direction may be given to the authority to take a decision on the same within a stipulated time, to which learned State Counsel has raised no objection. 4.

As agreed by learned counsel for the parties, this Court disposes of the writ petition directing opposite party

no.3 to take a decision on the recommendation made by the opposite party no.2 under Annexure-5 dated 07.01.2021, and pass appropriate order in accordance with law, as expeditiously as possible, preferably within a period of three months from the date of receipt of a certified copy of this order.

As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a print out of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed, vide Court's Notice No.4587 dated 25th March, 2020, as modified by Court's notice no. 4798 dated 15th April, 2021, and Court's Office Order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
