This matter is taken up through hybrid mode.

The Petitioner in this writ petition seeks for a direction to set aside the order dated 2nd December, 2021 (Annexure-3) passed by the Odisha Information Commission, Bhubaneswar in Complaint Case No.602 of 2017.

It is submitted by Mr. Mishra, learned counsel for the Petitioner that the complaint petition was filed by the Petitioner alleging inaction of the Public Information Officer (PIO), Jajpur Block in providing the information. Due to non-appearance of the Petitioner, the complaint case was dismissed on 2nd December, 2021. An application for restoration of the said complaint case was filed on 17th February, 2022 under Annexure4, but the same has not yet been taken into consideration. Hence, finding no other alternative, the Petitioner has filed this writ petition for the aforesaid relief.

// 2 // submits that copy of the writ petition has not yet been served. Hence, no instruction could be taken in the meantime. 5.

Taking into consideration the nature of grievance of the Petitioner, this writ petition is disposed of with an observation that the Petitioner, if so advised, may move the State Information Commission, Odisha, Bhubaneswar to take up his petition dated 17th February, 2022, if the same is still pending for consideration. Urgent certified copy of this order be granted on proper application.
