This matter is taken up through Video Conferencing mode. 2.

Heard Mr. R.L. Pattnaik, learned counsel for the Petitioner and Mr.B. Mohanty, learned Standing Counsel appearing for the School and Mass Education Department.

The limited grievance of the Petitioner in the present writ petition is that he has submitted a representation to the Controller, Board of Secondary Education, Odisha, Opposite Party No.1 on 16.9.2021. It is submitted by learned counsel for the Petitioner that Opposite Party No.1 has not taken any decision on the representation submitted by the Petitioner. Therefore, he prays for a direction to Opposite Party No.1 to dispose of the representation within a stipulated period of time.

Mr. Mohanty, learned Standing Counsel for the Department submits that he has no objection if a direction is given to the authorities to consider the representation of the Petitioner within a stipulated period of time.

In such view of the matter, the Opposite Party No.1 is directed to consider the representation of the Petitioner dated 16.09.2021 filed by the Petitioner, if any, within a period of six weeks from the date of production of this order. It is needless to mention here that the representation of the Petitioner shall be considered strictly in accordance with law and shall be disposed of by passing a speaking and reasoned order. Decision so taken on the representation of the Petitioner shall be communicated to the Petitioner within a period of ten days thereafter. 6.

With the above direction, the writ petition stands disposed of.

As the restrictions due to resurgence of COVID -19 situation are continuing, learned counsel for the parties may utilize a print out of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned Advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020 as modified by Court's Notice No.4798, dated 15th April, 2021 and Office Order dated 7th January, 2022.
