1. This matter is taken up through video conferencing.

2. This is an application under Sec.439 Cr.P.C. for bail and the offences alleged are under Secs.147/148/323/354/379/436/149, I.P.C.

3. Heard Mr. P.K. Samantaray, learned counsel for the Petitioners, Mr. M.K. Mohanty, learned A.S.C. for the StateOpposite Party as well as Mr. Ajit Rout, learned counsel for the informant.

4. It is submitted that the Petitioners are inside custody since 9.12.2021 and in the meantime investigation has progressed to substantial extent. It is also submitted that the Petitioners have been falsely implicated due to civil dispute.

5. It is submitted by Mr. Ajit Rout, learned counsel for the informant that the informant has no objection if the Petitioners are released on bail.

6. Upon hearing all the parties and considering the nature of allegations as well as the period of detention of the Petitioners inside custody, it is directed to release the Petitioners on bail in connection with Sundargarh Town P.S. Case No.252/2021 corresponding to G.R. Case No.1440/2021 on such terms and conditions to be fixed by the learned S.D.J.M., Sundargarh as he deems just and proper.

7. The BLAPL is accordingly disposed of.

8. As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020 as modified by Court's Notice No.4798, dated 15th April, 2021 and Court's Office Order circulated vide Memo No.514, dated 7th January, 2022.
