This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioners as well as learned Additional Government Advocate.

The Petitioners have filed the present writ application with the following prayer:
" It is therefore prayed that this Hon'ble Court graciously be pleased to direct the Opp.Party No.1 to fill up and to give appointment to the Petitioners as per their qualification out of 564 of vacant posts as mentioned in Annexure-2 (Office Order No31127/3/RD/CONF6, dated 17.10.2022 of Engineer-in-Chief, Rural Works), who were working near about or more than 27 years of continuous service under different Electrical Sections under RD Department and thereafter to fill up the rest vacant posts through regular recruitment process.
Or in alternatively to direct the Opp.Party No.1, to dispose of the representation dated 21.10.2022 of the Petitioners within a stipulated time bound period. And/or pass such order/orders, direction/directions in
// 2 // this Hon'ble Court may think fit and proper for the ends of justice."

In course of hearing of the writ application, learned counsel for the Petitioners submits that the Petitioners ventilating their grievance have submitted representation before the Additional Secretary, Rural Development (R.D.) Department, Government of Odisha, Opposite Party No.1 under Annexure-3. It is also submitted by the learned counsel for the Petitioners that the said representation is pending as of now. It is also submitted by the learned counsel for the Petitioners that a direction be issued to the Opposite Party No.1 to consider the representation of the Petitioners under Annexure-3 within a stipulated period of time.

Learned Additional Government Advocate submits that he has no objection if the representation of the Petitioners is considered by the Opposite Party No.1 which is stated to be pending, in accordance with law within a stipulated period of time.

Considering the limited nature of grievance of the Petitioners, the writ application is disposed of at the stage of admission with a direction to the Opposite Party no.1 to consider the representation of the Petitioners under Annexure-3 in accordance with law within a period of two months from the date of production of certified copy of this order. The Opposite Party No.1 shall do well to dispose of the representation of the Petitioners under Annexure-3 by passing a speaking and reasoned order. While considering the representation of the Petitioners, the Opposite Party No.1 is directed to take into consideration the order passed by this Court in Samir Kumar Dash and others-vrs.State of Odisha and others in W.P.(C) No.32972 of 2022 disposed of on 13.12.2022. The Petitioner is directed to submit a copy of the order dated 13.12.2022 along with the certified copy of

With the aforesaid observation, the writ application stands disposed of.
