This matter is taken up through virtual mode. Order No.

The Petitioners apprehending their arrest in Nilgiri P.S. Case No.303 of 2020, corresponding to C.T. Case No.419 of 2020, pending in the Court of S.D.J.M., Nilgiri, registered for alleged commission of offences punishable under Sections 376(1)(2)(n) and 506 of the I.P.C., have filed this petition for their release on pre-arrest bail. But, charge sheet filed under Section 368 of I.P.C. against the Petitioners in the meanwhile. 3.

Heard the learned counsel for the Petitioners and the learned counsel for the State.

It is submitted by the learned counsel for the State that the charge sheet in this case has been filed in the meanwhile and the Petitioners have complied with the notice under Section-41-A of Cr.P.C.

Considering the facts and submissions made, it is directed that if the Petitioners surrender before the Court in seisin over the matter and make a motion for bail, the Court in seisin over the matter shall release them on bail in connection with the aforesaid case on such terms and conditions as it may deem just and proper.

The ABLAPL is, accordingly, disposed of being allowed.

As restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout copy of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020 as modified by Court's Notice No.4798, dated 15th April, 2021 and Court's Office order circulated vide Memo Nos.514 & 515 dated 7th January, 2022.
