The Writ Petition involves oral threatening by the officer O.P. No.2, threatening the Petitioner to remove his business establishment being the single source of livelihood. Law has been settled requiring no eviction of even unauthorized encroacher without following the due process of law.

In the circumstance, this Court finds, there should not be eviction of the Petitioner without following due process of law. (Biswanath Rath) Judge Utkalika
