Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with G.R. Case No.888 of 2021, pending in the Court of the learned S.D.J.M., Patnagarh, arising out of Patnagarh P.S. Case No.209 of 2021, for commission of alleged offences under Sections 379/ 411/ 413/ 468/471/420-B/34 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Patnagarh by order dated 18.11.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

It is stated that the petitioner was in custody since 23.03.2022 and has been remanded in the case at hand on 29.04.2022. It is submitted that because of his criminal proclivity he has been arrayed as an accused in the case at hand and there are no materials to connect him with the alleged offence.

Learned counsel for the State opposes the prayer for bail keeping in view the criminal proclivity of the petitioner. 7.
Taking into account the nature of punishment and the basis of implication in the case at hand and as charge sheet is stated to have been filed, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin. 8.
Additionally, it is directed that petitioner shall appear before the jurisdictional police station once every week on such date and time be fixed by the learned Court in seisin till conclusion of trial.

Accordingly, the BLAPL stands disposed of.

Urgent certified copy of this order be granted as per the rules.
