Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 09.09.2021 in connection with Belpahar P.S. Case No. 92 of 201 corresponding to C.T. (Special) Case No. 68 of 2021 pending in the court of learned A.D.J.-cum-P.O. Special Court, POCSO, Jharsuguda for the alleged commission of offence under Sections 363 and 376(2)(n) of the IPC and under Section 6 of the POCSO Act.

Considering the submissions made, the materials on record, the period of detention already undergone and particular the testimony of the victim in the court below during trial, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition

that he shall personally appear before the trial court on each date of posting of the case without fail.

The BLAPL is accordingly disposed of.

Urgent certified copy of this order be granted on proper application.
