Heard learned counsel for the Parties.

Undisputedly for the involvement of the provision of O.G.L.S. Act and the requirements therein, the Additional Commissioner while holding he has no jurisdiction to grant the relief in exercise of power under Section 15(b) of the O.S.S. Act, as a consequence directed to the Tahasildar, Kodala to enter into desired action bringing the Writ Petition.

Mr.Routray, learned counsel for the Petitioner submits that even though direction given by the Additional Commissioner, Settlement and Consolidation, Berhmapur on 12.01.2018 vide Annexure-4, the Tahasildar, Kodala is still sitting over the matter. Considering the innocuous prayer involved herein but expressing its
// 2 // displeasure in the pendency of such litigation nearly for five years, this Court observes in the event the Tahasildar, Kodala has not concluded the required exercise, to conclude the required exercise at least within a period of four months from the date of communication of this order but however entering into required inquiry exercise and also giving opportunity to the Petitioner as well as any party likely to be affected. 4.
The Writ Petition thus stands disposed of.
