Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 24.09.2020 in connection with Jashipur P.S. Case No.129 of 2020 corresponding to C.T. Case No.508 of 2020 pending in the Court of learned Addl. District Judge, Karanjia for the alleged commission of offence under Sections 302/498(A) of IPC.

Though the allegation that the petitioner assaulted the deceased by means of a wooden plank causing fatal injuries on his head, yet the post mortem report clearly shows that no external injuries were found on the body of the deceased. 5.

Having regard to the above submission, materials on record and period of detention and the fact that charge sheet has already been submitted, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the

trial Court on each date of posting of the case without fail. 6.

BLAPL is accordingly disposed of.
