This matter is taken up through Hybrid Mode.

Mr. S.K.Joshi, learned counsel and his associates have entered appearance on behalf of the informant-opposite party No.2 3.

The Vakalatnama along with the affidavit filed by opposite party No.2 is taken on record.

Paragraph-2 of the said affidavit is quoted hereunder for convenience of ready reference.

"2. That although due to some dispute between myself and the Petitioner who is my Co-villager the Present F.I.R. has been lodged by me which has resulted the Present Case but in the meantime in flux of time because of interference of local gentleman the aforesaid dispute between us has been

amicably Settled for which at present good relationship as before is prevailing amongst us and to maintain such relationship I am no more interested to proceed further in this case 5.

Taking note of the aforesaid affidavit and the nature of allegations and in tune with the law laid down by the Apex Court in the case of Parbatbhai Aahir @ Parbatbhai Bhimsinhbhai Karmur and Ors. Vrs. The State of Gujarat and Anr., reported in AIR 2017 SC 4843, the proceeding in connection with S.A. Case No. 17 of 2017 arising out of Khariar P.S. Case No. 133 of 2015, on the file of learned Sessions Judgecum-Special Judge, Nuapada stands quashed in respect of the Petitioner in exercise of power under Section 482 Cr.P.C. 6.

Accordingly, the CRLMC stands disposed of.
