This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioners.

This is an application under Section 439 of the Code of Criminal Procedure filed by the Petitioners for bail in connection with Chauliaganj P.S.Case No.24 of 2016, corresponding to G.R.Case No.183 of 2016, pending in the Court of the learned J.M.F.C., Cuttack for alleged commission of offence under Sections 25(1-B)/27 of Arms Act, 1959.

Learned counsel for the Petitioners does not want to press this bail application and wants to withdraw the same at this juncture and prays that the trial court be directed to expedite the trial and the same be concluded within a stipulated period of time. 5.
Considering the aforesaid submissions, while disposing of the bail application of the Petitioners as withdrawn, this Court directs the trial court to expedite trial and conclude the same within a period of three months. In the event trial is not concluded within the aforesaid
// 2 // period, it is open for the Petitioner to move an application for bail and in the event such a bail application is filed the same shall be considered without being influenced by any other factor. 6.
