Heard Mr. S.K. Dash, learned counsel appearing for the petitioner and Mr. P.P. Mohanty, learned Addl. Government Advocate appearing for the State-opposite parties. 3.
The petitioner has filed this writ petition seeking direction to the opposite parties to cancel the bid submitted by opposite party no.5 and to award the work in favour of the petitioner on the strength of his financial bid as at Annexure-5 series. 4.
In course of hearing, learned counsel for the petitioner contended that opposite party no.5 having quoted less four decimal places, instead of two decimal places, as per AppendixIX(A) of OPWD Code Vol.(II), his bid is liable to be rejected, but the opposite party-authorities, in oblivious of the same, have declared the result of the financial bid in a clandestine manner to accommodate opposite party no.5, whose bid was also in violation of Clause-16.4 of the Detailed Tender Call Notice (DTCN). It is further contended that to the above context the petitioner has already made a representation before the opposite party no.3 vide
Annexure-6, and the same may be directed to be disposed of within a stipulated time, to which learned Addl. Government Advocate has raised no objection.

As agreed to by learned counsel for the parties and after going through the records, this Court disposes of the writ petition directing opposite party no.3 to consider the representation filed by the petitioner vide Annexure-6 and pass appropriate order in accordance with law before awarding the contract. Issue urgent certified copy as per Rules.
