This matter is taken up through Hybrid mode.

Order No.

This petition has been filed by the Petitioner-wife to transfer C.P No.16 of 2020 instituted at the instance of the Opposite Party-husband from the court of learned Judge, Family Court, Bhawanipatna to the court of Judge, Family Court, Bhubaneswar.

Heard learned counsel for the Petitioner.

The Petitioner has sought for transfer of the aforesaid case from the file of learned Judge, Family Court, Bhawanipatna to the court of Judge, Family Court, Bhubaneswar on the ground that she being a lady unable to attend the court there as the same is located at a long distance from her native place and she is also being threatened by the Opposite Party-husband. Therefore, for a free and fair trial, the

// 2 // case be transferred from the file of learned Judge, Family Court, Bhawanipatna to the court of Judge, Family Court, Bhubaneswar. But no material has been produced indicating that she has made any allegation before the police with regard to such threat extended to her.

Considering the facts and the submissions made, this Court is not inclined to transfer the aforesaid case to the court of Judge, Family Court, Bhubaneswar, but directs that C.P No.16 of 2020 pending on the file of the learned Judge, Family Court, Bhawanipatna to the court of Judge, Family Court, Berhampur. Both the Courts shall do the needful on production of the certified copy of this order.

However, if the Petitioner-wife claims travel expenses by filing an application, the court concerned shall pass necessary order on the same.

With the aforesaid order, this TRP(C) stands disposed of.

Urgent certified copy of this order be granted on proper application.
