Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 02.11.2021 in connection with Kodala P.S. Case No.568 of 2021 corresponding to G.R. Case No.1467 of 2021 pending in the Court of learned J.M.F.C., Khallikote for the alleged commission of offence under Sections 272 & 273 of IPC read with Section 52(a) of Orissa Excise Act. 4.

It appears that the petitioner was selling ID liquor, which was found to be mixed with urea, as revealed from the chemical examination report furnished by learned State Counsel. However, as it appears, investigation into the case seems to have progressed substantially. In the meantime similarly situated co-accused person, namely Suresh Patra @ Bitu has been released on bail as per order passed by this Court in BLAPL No. 10829 of 2021. 5.

Having regard to the above facts, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit

and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
