Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 15.12.2021 in connection with Baliguda P.S. Case No. 132 of 2018 corresponding to C.T. Case No. 25 of 2018 pending in the court of learned Special Judge, Baliguda for the alleged commission of offence under Sections 20(b)(ii)(C)/29 of NDPS Act.

Considering the submissions made, the materials on record, the period of detention already undergone and the fact that no contraband was seized from the possession of the petitioner and he has been implicated only on the basis of the statement of the coaccused coupled with the fact that similarly placed co-accused, namely. Praffula Digal has already been released on bail as per

order passed by this Court, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial court on each date of posting of the case without fail.

The BLAPL is accordingly disposed of.
