None appears for the Petitioner at the time of call, but it appears from the report submitted by learned Sessions Judge-cumSpecial Judge, Malkangiri that the Petitioner after availing interim bail has not surrendered to custody and, thereby, NBW has been issued against the Petitioner.

In view of the aforesaid facts, the present bail application is disposed of as dismissed and the learned Court in seisin of the case is requested to proceed against the Petitioner and the surety in accordance with law.
