The petitioner claims to be a resident of the area wherein O.P.

No.5-Raghunath Behera, proprietor of Bhagirathi 'ON' Beer Parlour is seeking permission from the Excise authorities for grant of licence for operating 'ON' Shop Beer Parlour.

2. By way of the instant writ petition the challenge has been laid to the issuance of the statutory public notice in Form-VIII inviting objections.

3. At the time of hearing, learned counsel for the petitioner in view of the reply filed reflecting that the licence has since been granted to O.P. No.5 prays for permission to withdraw the present writ petition to enable his client, if so advised, to file a fresh petition challenging the order whereby the licence to O.P. No.5 has been granted.

4. Mr. Samantaray has no objection.

5. In view of the above, the writ petition is dismissed as withdrawn with the aforesaid liberty.
