Heard learned counsel for the petitioners and learned counsel for the State.
This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioners in connection with I.C.C. Case No.23 of 2021 pending in the Court of learned S.D.J.M., Jajpur for alleged commission of offences under sections 420/506/34 of the Indian Penal Code.
Perused the complaint petition annexed as Annexure-1.
// 2 // It is a case which arises out of a complaint petition in which after taking of cognizance, summons have been issued to the petitioners for their appearance.
Since there is no apprehension of arrest of the petitioners in the case, while not inclining to grant anticipatory bail to the petitioners, it is observed that in the event the petitioners appear in the concerned Court within a period of four weeks from today and move an application for bail, the same shall be disposed of as expeditiously as possible by the Courts below in accordance with law. The case records shall be made available to the Court concerned.
The ABLAPL is accordingly disposed of.
