Heard Mr. M. Kanungo, learned Sr. Counsel appearing along with Mr. S.R. Mohanty, learned counsel for the petitioner and Mr. T.K. Pattnaik, learned Additional Standing Counsel for the State.

The petitioner has filed this writ petition to quash the letter dated 05.11.2021 under Annexure-3 issued by the Tahasildar, Kasinagar in the district of Gajapati. 4.
Mr. T. K. Pattnaik, learned Additional Standing Counsel for the State contended that as per Rule-27(4)(iv) of the Odisha Minor Mineral Rules, 2016, the petitioner has to submit solvency certificate or bank guarantee, but in the present case the petitioner has submitted self Net Worth Certificate, which is not contemplated in the rules. 5.
Considering the contentions raised by learned counsel
for the parties and after going through the records, it appears that the petitioner has not submitted solvency certificate or bank guarantee, as contemplated under Rule-27(4)(iv) of the Odisha Minor Mineral Rules, 2016, but it has submitted self Net Worth Certificate. Hence, rejection of the tender of the petitioner is justified. Therefore, this Court is not inclined to entertain the writ petition.

In view of the above, the writ petition merits no consideration and the same is accordingly dismissed. ...........................
