The present Writ Petition has been filed with the following prayer:- " Therefore, it is respectfully prayed that this Hon'ble Court may graciously be pleased to Admit this Writ Petition, issue rule Nisi for calling upon Opp. Parties for show cause as to why the direction will not be issued for enlisting the names of the petitioners in the displaced family persons list as the family of the petitioners also displaced for establishment of Lower Suktel Irrigation Project. This Hon'ble Court be pleased to make its rule absolute if the said opp. parties fail to submit sufficient cause or show insufficient cause and after hearing from the parties, this Hon'ble Court may direct in the writ of Mandamus to the opp. Parties particularly the Opp. Party Nos.

4 & 5 for enlisting the names of the petitioners in the survey list as displaced family persons in Lower Suktel Irrigation Project. This Hon'ble Court may be pleased to direct to the opp .party No.5 for early disposal of the representation dtd.19.10.2022 by providing adequate opportunity of hearing to the petitioners, as it is pending before him without any consideration for the interest of justice and equity".

In course of hearing, learned counsel for the Petitioners states that highlighting their grievance, the Petitioners have made representation to Opposite Party No.5 vide Annexure-3 and the same may be directed to be considered within a stipulated time, to which learned Counsel for the State has no objection.

As agreed by learned counsel for the parties and after going through the records, this Court, without expressing any opinion on the merits of the case, disposes of the Writ Petition directing Opposite Party No.5 to consider the representation filed by the petitioners vide Annexure-3, and pass appropriate order in accordance with law within a period of four weeks from the date of production of certified copy of this order. Issue urgent certified copy as per Rules.
