The petitioner has filed this writ petition seeking direction to the Tahasildar Bhograi to finalize the present application as applied by the petitioner's Union to settle the land in question as per the present case, i.e. the Land Encroachment Case No. 56 of 2022 in Khata No. 459, Plot No. 1493/1656 under mouza-Jaleswarpur in Bhograi Tahasil in the name of the petitioner's Union who is possession since long period by depositing the penalty fixed in every year on the basis of earlier application dated 21.01.1994 for lease, by issuing fresh ROR.

In course of hearing, learned counsel for the petitioner states that highlighting the grievances, the petitioner has made representation to the opposite party no.3 vide Annexure-5 and the same may be directed to be disposed of within a stipulated time, taking into consideration Annexure-2 and 3 series, to which learned Counsel for the State has raised no objection. 5.

As agreed to by learned counsel for the parties, however, without expressing any opinion on the merits of the case, this writ petition stands disposed of directing the opposite party no.3 to consider the representation filed by the petitioner vide Annexure-5 taking into consideration Annexure-2 and 3 series and pass appropriate order in accordance with law within a period of three months from the date of production of certified copy of this order. Issue urgent certified copy as per rules.
