2. Heard Mr. R.K. Patnaik, learned counsel for the petitioner.

3. The petitioner has filed this writ petition seeking direction to opposite party No.1 to sanction and disburse the grade pay of Rs.4600/- in Second RACP on completion of 20 years service & Rs.5400/- in 3rd RACP on completion of 30 years and pay differential arrear financial benefits in his favour within a stipulated period in the light of judgment passed in State of Odisha & another v. Bihari Lal and others.

4. In course of hearing, Mr. R.K. Patnaik, learned counsel for the petitioner states that the petitioner may be permitted to move a fresh representation highlighting his grievances before opposite party no.1 so that the same can be considered in the light of the ratio decided by this Court in Bihari Lal and others (supra).

5. Considering the limited nature of grievance of the petitioner, this Court directs the petitioner to file a fresh representation within a period of fifteen days from today ventilating his grievances before opposite party no.1. In the event the petitioner files such representation along with the judgment passed by this Court in Bihari Lal (supra), opposite party no.1 shall consider and pass appropriate order taking into consideration the ratio decided in Bihari Lal (supra) within a period of two months thereafter.

6. With the aforesaid observation and direction, the writ petition is disposed of.

As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a print out of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed, vide Court's Notice No.4587 dated 25th March, 2020, as modified by Court's notice no. 4798 dated 15th April, 2021.
