Heard learned counsel for the petitioner and learned counsel for the State.
This is an application under section 438, Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Paradeep Lock P.S. Case No.226 of 2021 corresponding to G.R. Case No.897 of 2021 pending in the court of learned J.M.F.C., Kujang for alleged commission of offences under sections 454, 395 of the Indian Penal Code and sections 25 and 27 of the Arms Act.
Perused the F.I.R. annexed to the anticipatory bail application.
Learned counsel for the State submitted that
// 2 // charge sheet has been submitted against the petitioner for the offence under section 395 of the Indian Penal Code showing him as an absconder and the co-accused has been arrested and he has been identified in the test identification parade. He further submitted that there is necessity of conducting test identification parade in respect of the petitioner. In view of such submission, I am not inclined to release the petitioner on anticipatory bail.
The ABLAPL stands dismissed.
