Jayadeba Pany v. State Of Odisha
IN THE HIGH COURT OF ORISSA AT CUTTACK
W.P.(C) No. 34423 of 2022 Jayadeba Pany .....
Petitioners Mr. S.N. Biswal, Adv.
Vs.
State of Odisha and others .....
Opposite Parties Mr. S. Jena, Standing Counsel, S&ME
CORAM:
DR. JUSTICE B.R. SARANGI
ORDER
22.12.2022 Order No.
01.
This matter is taken up through hybrid mode.
2.
Heard Mr. S.N. Biswal, learned counsel for the petitioner and Mr. S. Jena, learned Standing Counsel appearing for the School and Mass Education Department.
3.
The petitioner has filed this writ petition seeking to quash the order dated 30.06.2011 under Annexure-6 and the office orders dated 18.10.2022 and 09.11.2022 under Annexure-9 series, and to issue direction to the opposite parties to pay the petitioner all the service and financial benefits with arrear as per the pay revision under ORSP Rules. 4.
As it appears, by letter dated 18.10.2022, the Block Education Officer, Kamakhyanagar called upon the petitioner to submit his written consent regarding fixation of his pay by availing change of option or normal pay fixation without change of option under different ORSP Rules, within seven days. But the letter itself indicates that as per the objection made by the Director, Elementary Education, Odisha, Bhubaneswar, at the time of post checking of pay fixation statements (ORSP Rules, 2008), sanction of notional increment during absence period of 1983 and 1984 is not regular.
5.
In the above view of the matter, this Court is not inclined to entertain this writ petition, which is accordingly dismissed. Ashok (DR. B.R. SARANGI) JUDGE
