Learned State Counsel submits that notice on the victim was served on 09.03.2022, however, there is no appearance from her side. As such, the matter is taken up for hearing. 3.

Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 31.08.2021 in connection with Tangi P.S. Case No.305 of 2021 corresponding to T.R. Case No.389 of 2021 pending in the Court of learned Addl. Sessions Judge, Bhubaneswar for the alleged commission of offence under Sections 363/365/366/376(3) of IPC, read with Section 4 of POCSO Act, Section 9 of Prohibition of Child Marriage Act and Section 3(2)(v)(va) of SC & ST (POA) Act.

Considering the submissions, materials on record and the fact of submission of charge sheet and the statement of the victim recorded under Section 164 of Cr.P.C., I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall

personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
