Heard learned counsel for the parties.

The present Writ Petition has been filed with the following prayer:- "It is therefore prayed that, this Hon'ble Court may graciously be pleased to consider the facts stated in the petition, admit the writ petition, issue notice t the Opposite parties, calling upon them to file show cause as to why the writ petition shall not be allowed if they fail to show cause or show insufficient cause this writ petition may kindly be allowed thereby directing the Opposite party No.2 i.e Collector and District Magistrate, Balasore to consider the representation dtd.02.12.2022 under Annexure-11 and direct the Opposite Party No.4 i.e. Tahasildar, Soro to conduct a proper inquiry in presence of the petitioner with regards to excess extraction of stone from Khanjamahal stone Quarry No.84 and pass appropriate order in accordance with law.

And may pass any other order/orders, direction/directions as this Hon'ble Court may deem fit and proper.

In course of hearing, learned counsel for the Petitioner states that highlighting his grievances, the Petitioner has made a representation to Opposite Party No.2 vide Annexure-11 and the same may be directed to be considered within a stipulated time, to which learned Counsel for the State has no objection. 5.

As agreed by learned counsel for the parties and after going through the records, this Court, without expressing any opinion on the merits of the case, disposes of the Writ Petition directing Opposite Party No.2 to consider the representation filed by the petitioner vide Annexure-11 and pass appropriate order in accordance with law within a period of four weeks from the date of production of certified copy of this order.

Issue urgent certified copy as per Rules.
