This matter is taken up through Hybrid Mode.

Learned counsel for the Opposite Party No.2 (Informant) has entered appearance through Mr. R.K. Pradhan and associates. The Vakalatanama filed on behalf of the said Opposite Party in Court is taken on record.

Heard Mr. S.N. Biswal, learned counsel for the petitioner, Mr. P. Mohapatra, learned Additional Standing Counsel for the State and Mr. R.K.Pradhan, learned counsel appearing for the Opposite Party No.2.

The aforesaid CRLMC has been filed for quashing of the proceeding in C.T. Case No.1963 of 2019 on the file of Learned

S.D.J.M., Bhubaneswar arising out of Laxmisagar P.S. Case No. 115 of 2019.

The Opposite Party No.2-informant has filed an Affidavit stating inter alia that, the matter has been settled out of Court and he does not want to pursue the 1. C.C. Case, which is the subject matter challenged in this present CRLMC.

Taking note to such submissions and taking into account the affidavit of the informant and in tune with the law laid down by the Apex Court in case of Parbatbhai Aahir alias Parbatbhai Bhimsinhbhai Karkur and others v. State of Gujarat and another, reported in AIR 2017 SCC 4843, the proceeding in connection with C.T. Case No.1963 of 2019 on the file of Learned S.D.J.M., Bhubaneswar arising out of Laxmisagar P.S. Case No. 115 of 2019 stands quashed, in exercise of power under Section-482 Cr.P.C.

The CRLMC thus stands disposed of.
