Learned counsel for the State submitted that in the meantime, on completion of investigation, charge sheet has been submitted but the investigation has been kept open and the petitioner has not been charge sheeted.

Since there is no apprehension of arrest of the petitioner, I am not inclined to entertain the application under section 438 of Cr.P.C. The petitioner is at liberty to seek appropriate remedy in the event any charge sheet is submitted against him or there is any reasonable apprehension of arrest against him. The ABLAPL is accordingly disposed of.
