This matter is taken up through hybrid mode.

Heard Mr. J.R. Khuntia, learned counsel for the petitioner and Mr. B. Mohanty, learned Standing Counsel for School & Mass Education Department.

Against rejection of the claim of the petitioner for remuneration for the period from 01.05.2014 to 31.05.2015 under Annexure-12, the petitioner has approached this Court in the present writ petition. 4.

Mr. J.R. Khuntia, learned counsel for the petitioner contended that though the petitioner has complied the requirements, but till today, he has not been paid the amount as due and admissible to him. 5.

Mr. B. Mohanty, learned Standing Counsel contended that since the petitioner has not complied with the requirement, he has not been extended with the benefits.

Having heard learned counsel for the parties and after going through the record, it appears that the claim of the petitioner for remuneration for the period from 01.05.2014 to 31.05.2015 has not been released since the petitioner has not complied the following conditions.

1) In Letter No.356, dated 17.03.2016 the then BEO,

Narasinghpur has clearly mentioned that Sri Sangram Singh has not signed the Staff attendance Register from April -2014 to March 2015.

2) The tour dairy for the above said period, submitted by Sri Sangram Singh and transmitted to this Office Vide Letter No. 1359, dated 26.12.15 of BEO, Narasinghpur is not approved by the BEO concerned.

3) PAR submitted by Sri Sangram Singh for the year 2014-15 is also not certified by the BEO concerned.

4) In Letter No. 278, dated 20.03.2015 BEO, Narasinghpur had intimated to this Office that Sri Sangram Singh was neither attending the Office on regular basis nor in weekly review meeting.

5) In Letter No.425, dated 08.05.2015 BEO, Narasinghpur also submitted adverse report on performance of Sri Sangram Singh.

6) All these matters were previously brought to the kind notice of Collector-cum-Chairman, Samagra Shiksha, Cuttack and it was rejected for consideration of release of his remuneration for the period from 01.05.2014 to 31.05.2015."

In course of hearing, learned counsel for the petitioner contended that the petitioner is ready and willing to comply the observations made above.

In view of the above, this writ petition stands disposed of permitting the petitioner to comply with the aforesaid conditions within a period of four weeks, so that the authority can re-consider the same and pass appropriate order in accordance with law. 9.

With the aforesaid observation/direction, the writ petition stands disposed of.
