Heard Ms. P.P. Mohanty, learned counsel for the petitioner and Mr.

A.K.

Nanda, learned Additional Government Advocate.

According to Ms. Mohanty, the petitioner is aggrieved by rejection of his claim under Annexure-2 by the SubCollector, Kamakhyanagar (opposite party no.2) for being covered under "displaced category" and thereby depriving him of his legitimate benefits under the Odisha Rehabilitation and Resettlement Policy 2006. During course of hearing, she submits that liberty may be granted to the petitioner to approach the Collector, Dhenkanal (opposite party no.1) by filing a representation for redressal of his grievances and further prays that the said opposite party be directed to take a decision on such representation within a stipulated time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court

// 2 // grants liberty to the petitioner to approach the opposite party no.1 by filing a representation along with a certified copy of this order through Registered Post within a period of two weeks. In the event, such an application is filed before opposite party no.1, he/she is directed to take a decision on the same in accordance with law within a period of three months from the date of receiving of such representation after giving reasonable opportunity of hearing to the petitioner and communicate the result of such exercise to the petitioner.

The writ application is accordingly disposed of. 5.
