This matter is taken up through hybrid mode.

This bail application had been filed with a prayer for releasing the petitioner on interim bail for a period of one month on the ground of illness of his father Sri Narottam Das. During pendency of the bail application father of the petitioner Narottam Das expired during treatment in the hospital for which the petitioner had been granted interim bail for a period of seven days vide order dated 04.01.2022 passed in I.A. No.1381 of 2021. He has thereafter surrendered on 12.01.2022 in the Court of the learned 3rd Addl. District & Sessions Judge, Cuttack and has been remanded to custody.

Mr. Subhrajeet Jena, learned counsel submits that a Vakalatnama has been filed on behalf of Mr. G.M. Rath and associates, learned counsel for the informant today and prays for an adjournment.

In view of the fact that the petitioner has already surrendered in custody after availing interim bail period and his
// 2 // father has expired the BLAPL has become infructuous and there is no necessity to adjourn the case.

The BLAPL is accordingly dismissed as infructuous. 6.
Urgent certified copy of this order be granted on proper application.
